Fly Buys WIN GREAT STUFF Competition Terms & Conditions

  1. The Fly Buys WIN GREAT STUFF competition is run by Loyalty New Zealand Limited (Loyalty) and is governed by these terms and conditions and the Fly Buys Membership Terms and Conditions at www.flybuys.co.nz. By entering the competition, you agree to these terms and conditions
  2. Loyalty will be running the competition between 12am on 3rd May 2015 and 11.59pm on 6th June 2015 (Promotional Period).
  3. Anyone can enter the competition during the Promotional Period by clicking on the ‘Enter Now’ button on the competition application within the Fly Buys’ Facebook page.
  4. During the Promotional Period there will be 5 weekly prize draws each week with 10 winners receiving 1 prize each. (There are a total of 10 prizes per week). The prizes are a selection of rewards as shown each week within the competition application, pre-determined by Fly Buys that will be randomly drawn for each winner. The prizes are not transferable for cash or any other Fly Buys rewards of the same value.
  5. To be eligible to enter the weekly prize draws you must be a Fly Buys Cardholder and during the relevant week:
    1. correctly answer the question; and
    2. following completion, enter your details including your Fly Buys card number.
  6. Loyalty New Zealand will conduct each weekly prize draw from all Fly Buys cardholders who have submitted correct answers from 12am Sunday to 11.59pm the following Sunday each week, between the promotional period of 3rd May and 6th June 2015. The 10 winners of each Weekly Prize Draw will be drawn on the next working day (Monday) following the closing time for that prize draw.
  7. Each eligible entrant will only receive one entry into each weekly prize draw. Each Fly Buys Cardholder is only eligible to win one prize in any of the Weekly Prize draws.
  8. You can enter the competition once per week during the Promotional Period.
  9. The Prize Draws will be held weekly on:

Week 1 - Monday 11th May 2015
Week 2 - Monday 18th May 2015
Week 3 - Monday 25th May 2015
Week 4 - Monday 1st June 2015
Week 5 - Monday 8th June 2015

  1. Loyalty will conduct a weekly random prize draw from all Fly Buys cardholders who have submitted their answers. The first 10 eligible entries drawn each week will win a pre-determined prize of a Fly Buys reward.
  2. All winners will be contacted by Loyalty New Zealand to organise delivery of the prize.
  3. If you are a winner, Loyalty New Zealand will make reasonable efforts to contact you using your contact details held by Fly Buys. If for any reason Loyalty New Zealand is unable to make contact with a winner within 5 working days following the draw (despite its efforts to do so) then that Prize will be deemed to be unclaimed and forfeited and another winner may be drawn for that prize.
  4. Employees of Loyalty are ineligible to win.
  5. Any win that Loyalty reasonably suspects (in Loyalty’s sole discretion) has involved or may involve fraud, bugs, tampering, hacking or any other unauthorised intervention will be null and void.
  6. The information provided will be dealt with in accordance with these terms and conditions, the Fly Buys Membership Terms and conditions, Fly Buys’ Privacy Statement and the Privacy Act 1993.
  7. The Promoter reserves the right to discontinue, cancel or amend this promotion and these terms and conditions at any time without notice.
  8. The Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook, and each participating Fly Buys Cardholder agrees not to hold Facebook liable in any way in association with the Competition.

Fly Buys & Z Facebook Timeline 250 Bonus Points Giveaway Competition - Terms and Conditions

  1. Fly Buys & Z Facebook Timeline 250 Bonus Points Giveaway Competition (Competition) is run by Loyalty New Zealand Limited (Promoter) and is governed by these terms and conditions and the Fly Buys Membership Terms and Conditions at www.flybuys.co.nz (together the Terms and Conditions). By entering the Competition, you agree to the Terms and Conditions.
  2. The promotional period runs from 3.00pm on Wednesday 20 May until midnight on Thursday 21 May 2015 (Promotional Period).
  3. You will get an entry into the Competition draw to win 1 of 5 prizes of 250 bonus points if you are a Fly Buys Member or secondary cardholder (each a Fly Buys Cardholder) and during the Promotional period you submit an answer to the question in the Competition Post by adding a comment to the Competition Post.
  4. You may enter the Competition as many times as you like during the Promotional Period.
  5. Loyalty’s judging panel will select 5 winners from all Competition entries in a draw held by the Promoter on Friday 22 May 2015.

Fly Buys Auctions Terms & Conditions

Welcome to the terms and conditions of use of the Fly Buys rewards auction page (“Auction Page”).

These terms and conditions and the Fly Buys Membership Terms and Conditions (together the “Terms”) apply to all users (“you”) of the Loyalty New Zealand Limited, managers of the Fly Buys programme, (“we”, “us” and “our”) Fly Buys Auction Page (“Auction Page”). The Terms apply to any use of the Auction Page, including online reward auctions and "Buy Now" rewards (the “Service”).

When you register with the Service by using your Facebook profile you are deemed to have accepted, and will be bound by the Terms, as amended and varied by us from time to time.

As this is a platform that operates within Facebook you will also need to ensure that your activity on the Auction Page also complies with Facebook’s terms and conditions of use.

This Service has been set up by us to auction selected Fly Buys rewards.

General Terms of Use:

  1. You may not take any action that might interfere with the operation of the Auction Page.
  2. You must not use any device, software or instruction to interfere or attempt to interfere with the proper working of the Auction Page.
  3. You must not disclose or share your password to or with any third parties or use your password for any unauthorised purpose.
  4. You are solely responsible for your transmissions through the Auction Page. You must:
  • not forge communications or take any other action which would disguise the origin of the communications transmitted by you through the Service;
  • not allow another person to transmit communications that falsely identifies your account as the origin of such a communication;
  • not interfere with or disrupt the Service;
  • not use the Service for illegal purposes; and
  • comply with all regulations, policies and procedures related to the Service.
  1. We reserve the right to determine whether or not your conduct is consistent with these Terms and what we believe is good practice for the Auction Page. We may, in our sole discretion, immediately terminate your Account and use of the Service if your conduct is deemed by us to be inconsistent with the Terms or our standards of practice, acting reasonably.

Registering for use and your information

  1. You must register your details with Buddy Bid Limited (“Buddy Bid”), who run the Auction Page on our behalf,  to use the Service (your "Account"). Registration is free and does not oblige to you bid for any reward. You must not use false or misleading information when registering or using the Service. Your obligations to us won't be reduced for any reason including (for example) where you use a false name.
  2. If your details have changed since you last used the Service, you must provide updated details. We are not responsible for any loss or damage (including misdirected emails or deliveries) which may occur because you have not provided us with complete and accurate information.
  3. You are responsible for the security of your user name and password. We may assume that anyone using your user name and password is authorised by you.
  4. Unauthorised access and use of your details will, under no circumstances, reduce your liability in connection with using the Service. This includes your obligation to redeem for a reward using your Fly Buys points which may result from use of your user name and password. You must notify us or Buddy Bid immediately if you become aware of any unauthorised use of your user name or password or of any other security breach.
  5. We intend to send notifications to you by e-mail of:
  • the status of an online auction in which you are participating, such as “you have been outbid” e-mails, or "you are the Winning Bidder" emails;
  • sales confirmation for "Buy Now" rewards; and
  • the status of your delivery, if applicable.

However, we accept no liability for any loss or damage incurred if, for whatever reason, you do not receive such notifications.

The Auction Page is administered by Buddy Bid on our behalf. The personal information that you provide when registering an Account, along with details related to your auction activity, will be collected by Buddy Bid and held by it at 2.1 / 30 St Benedict St, Newton, Auckland, New Zealand. You consent to the personal information provided when you register, along with your auction activity, being collected by Buddy Bid and disclosed to and used by us and Buddy Bid for the purposes of administering and completing a reward  auction and for marketing, research and development in relation to such reward auctions.

 

Eligibility to participate

  1.        The Service may not be used by anyone under the age of 18.

Your rights and obligations

Online Auctions - Your obligations as a bidder

  1. When you use the Service to bid at an online auction, you are making an offer to redeem for the reward at your bid amount using your Fly Buys points. If your bid amount is the Winner's Bid Amount, you will be the Winning Bidder and you must redeem the item you have bid for at the Winner's Bid Amount using your Fly Buys points.
  2. Please take care when making a bid as once your bid is placed, it cannot be withdrawn. It is your responsibility to check your Fly Buys points balance to confirm that you have the number of Fly Buys points required to redeem for a reward if you are the Winning Bidder.
  3. Please take care when setting an Autobid, as once your Autobid is placed, it cannot be altered or withdrawn.
  4. It is your responsibility to read the product information and overview relating to any reward listed for auction on the Auction Page. Please do not rely solely on the title summary or any photographs of the reward posted on the Auction Page for a complete description of a reward. You must not assume that the description or photograph of the reward in any way offers an opinion or an assessment of the suitability of a reward for you. If a photograph is provided, please use it as a guide only.
  5. Please make sure you understand the reward delivery terms given in the relevant reward description.

Online Auctions - Your obligation to pay

  1. If you are the Winning Bidder in an auction, you must use your Fly Buys points to redeem for the reward at the Winner’s Bid Amount.
  2. Notwithstanding that you have been notified that you are a Winning Bidder, we may in our sole discretion withdraw and not proceed with completion of the redemption of the reward if you do not have the required number of Fly Buys points to redeem for the reward at the Winner’s Bid Amount, or we are unable to contact you for any reason (see paragraph 20 (f)).

The Online Auction Process

  1.        Procedure
    1. You may bid:
      1. by placing a normal bid; or
      2. through AutoBid.
    2. If you bid using AutoBid, you are responsible for monitoring the online auction in which you are participating and acting in the auction by instructing AutoBid with your bids.
    3. An auction will start at the specified time and at the specified reserve points amount.
    4. All bids placed at an auction:
      1. must be made on a per-item basis; and
      2.  may only be increased by multiples of the posted bid increment.
    5. We set a minimum number of points for each reward we auction at which the bidding must start.
    6.  We have discretion to close an auction before the scheduled time. For example, we may close an auction if:
      1. there is or we suspect there may be, fraudulent or malicious bidding; or       
      2. there are technological errors or Auction Page failure;  
    7. Bids will be ranked in the following order of precedence:
      1. bid points value;
      2.  bid quantity; and
      3. initial bid time.

For example, if two or more bids are for the same points value, the higher quantity will take precedence. If two or more bids are for the same points value and bid quantity, the time the bidder placed their first bid on the reward takes precedence.

  1. All bids placed on auctions are made on a per-item basis and bid amounts may only be increased in multiples of the specified bid increment. While you are the current highest bidder on an auction, you will not be permitted to lower your current bid with a new lower bid, nor will you be permitted to lower your bid quantity with a new bid. If you want to decrease your quantity, you must wait until your current highest bid is exceeded by another bidder.

 

  1.        Conclusion of an auction
    1. The auction closes at the end of the time period specified for that auction where there are no new successful bids during the 3 minutes immediately preceding the end of the time period specified.
    2. If there are any successful bids on a particular reward within the last 3 minutes of the close of the auction, the auction will be extended for a further period until there are no more bids within the last 3 minutes (“Refresh Period”). The Refresh Period may vary from time to time by a number of seconds. We accept no responsibility for any circumstances or incidents arising as a result of any slight variations that may occur in the Refresh Period.
    3. When an auction in which you have participated closes and you are the Winning Bidder, we intend to notify you by e-mail.
    4. This notice will include:
      1. notification that you are the Winning Bidder and of the amount of points relevant to your winning bid, the reward number and description, and notification that you’ll be called by us  to process the redemption for the reward.
      2. We provide this notice out of courtesy and as a reminder to you. You may not receive this email, however, you are solely responsible for monitoring the status of any auction in which you participate and non-receipt of a Winning Bidder (or any other) email from us will not reduce or release you from your obligation to complete the redemption of the auction reward.
      3. If you are the Winning Bidder for a reward at an auction, you must complete the transaction by using your Fly Buys points to redeem for that reward.
    5. You acknowledge that:
      1. all points amounts are shown in Fly Buys points; and
      2. you must redeem  for goods and services, in Fly Buys points and cannot pay for the reward or any part of it in cash.
    6. Within 48 hours of an auction closing, we will contact you if you are a Winning Bidder (using your details provided when you registered an Account or your details held by us) to:
      1. confirm your identity as the Winning Bidder;
      2. confirm that you have enough points to redeem for the reward at the Winning Bid Amount;
      3. confirm where you would like the reward delivered to; and
      4. process the redemption using your Fly Buys points.
    7. If for any reason we are unable to contact you within 72 hours of the relevant auction closing, having made reasonable efforts to do so, we may, at our discretion, deem:
      1. you to have forfeited your right to the reward you’ve won in that auction and
      2. that the Fly Buys member with the bid amount closest to the Winning Bid Amount for that auction becomes the Winning Bidder for the purposes of that auction.
    8. Time - online auctions
      1. When bidding on auctions through the Auction Page the time will be New Zealand Standard Time (NZST).
  2. Our rights
    1. We may refuse you the right to use the Service if you:
      1. do not use your Fly Buys points to redeem for the reward and/or refuse delivery of the reward;
      2. give information which is untrue, inaccurate or incomplete; or
      3. have engaged in any form of bid manipulation.

In those circumstances you may be permanently suspended from the Service.

  1. We may suspend, cancel or terminate your access to the Service if you breach or fail to observe the Terms or for any other reason at our discretion. However, we will not exercise our discretion unreasonably. If we suspend your access to the Service, you may not register again.
